Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the NotarySites.co website, mobile applications, and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.
If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to both you individually and that organization.
Account Registration
Eligibility
To use the Platform, you must be at least 18 years old and legally capable of entering into binding contracts. If you are a notary public, you must hold a valid commission in your state of practice.
Account Information
You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
Account Security
You must notify us immediately of any unauthorized use of your account or any other security breach. We will not be liable for any loss arising from your failure to protect your account credentials.
Permitted Uses
The Platform is designed to help notary professionals manage their business operations. You may use the Platform to:
- Manage client information and records
- Schedule and track appointments
- Maintain digital notary journals in compliance with state law
- Create and send invoices
- Process payments through integrated payment services
- Build and manage professional websites
- Generate marketing content using AI tools
- List services in the notary marketplace
Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of these Terms
- Provide false, misleading, or inaccurate information
- Impersonate any person or entity
- Share your account credentials with others
- Attempt to access accounts or data belonging to others
- Interfere with or disrupt the Platform's operation
- Use automated systems to access the Platform without permission
- Attempt to circumvent security measures
- Use the Platform to transmit malware or harmful code
- Violate any applicable notary laws or regulations
- Use AI-generated content in ways that violate third-party rights
Subscription and Payments
Subscription Plans
We offer both free and paid subscription plans. The features available depend on your subscription level. Paid subscriptions are billed on a recurring basis (monthly or annually) until cancelled.
Payment Processing
Payments are processed through Stripe. By providing payment information, you authorize us to charge your payment method for subscription fees and any applicable taxes.
Free Trial
We may offer free trials of paid features. At the end of the trial period, you will be charged unless you cancel before the trial ends.
Cancellation and Refunds
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We offer a 30-day money-back guarantee for new paid subscriptions.
Price Changes
We may change subscription prices with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.
Your Content and Data
Ownership
You retain ownership of all content you upload to the Platform, including client data, journal entries, and business information ("Your Content").
License Grant
By using the Platform, you grant us a limited license to use Your Content solely to provide and improve the Platform. This license terminates when you delete Your Content or close your account.
Responsibility
You are solely responsible for Your Content and ensuring it complies with all applicable laws, including state notary regulations. You represent that you have all necessary rights to the content you upload.
Data Export
You may export Your Content at any time through the Platform's export features. We recommend maintaining regular backups of your data.
AI-Generated Content
The Platform may use artificial intelligence to generate marketing content, blog posts, and other materials. You acknowledge that:
- AI-generated content is provided for your review and editing before publication
- You are responsible for reviewing and approving all content before use
- AI-generated content may require fact-checking and modification
- We do not guarantee the accuracy or completeness of AI-generated content
- You should not rely on AI content for legal advice
Notary Marketplace
The Platform includes a marketplace where notaries can list their services. By listing your services, you agree to:
- Provide accurate information about your services, qualifications, and availability
- Maintain a valid notary commission in all states where you offer services
- Respond promptly to client inquiries
- Provide professional services in accordance with applicable laws
- Not discriminate against clients based on protected characteristics
We do not guarantee any particular level of business through the marketplace and may remove listings that violate these Terms or our policies.
Intellectual Property
The Platform, including its design, features, code, and content (excluding Your Content), is owned by NotarySites.co and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
The NotarySites.co name, logo, and related marks are our trademarks. You may not use them without our prior written consent.
Third-Party Services
The Platform integrates with third-party services including:
- Stripe for payment processing
- Google Maps for location services
- Google Calendar and Gmail for calendar synchronization and email notifications
- Microsoft Outlook and Outlook Calendar for calendar synchronization and email notifications
- Emailit and Twilio for communications
- Claude AI for content generation
Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for third-party services or their availability. By connecting third-party integrations, you authorize us to access and use data from those services as described in our Privacy Policy.
Google and Microsoft Integration Terms
When you connect your Google or Microsoft account to the Platform, the following additional terms apply:
Authorization and Scope
By connecting your Google Calendar, Gmail, Microsoft Outlook, or Outlook Calendar account, you explicitly authorize NotarySites.co to access, read, and write data within the scopes you approve during the OAuth consent process. You may review the specific permissions requested before granting access.
How We Use Integration Data
Data accessed through Google and Microsoft integrations is used to:
- Synchronize calendar events between the Platform and your connected calendar
- Check your availability to prevent double-booking when clients schedule appointments
- Create, update, and cancel calendar events for booked appointments
- Send appointment confirmations, reminders, and notifications on your behalf
- Improve and develop the Platform's scheduling and calendar features
Data Protection for Integration Data
- We do not use Google or Microsoft data for advertising, including retargeting, personalized, or interest-based advertising
- We do not sell Google or Microsoft user data to any third party
- We store OAuth tokens securely using encryption and automatically revoke tokens when you disconnect an integration
- We limit internal access to integration data to personnel who require it to provide and maintain the service
Revoking Access
You may disconnect any Google or Microsoft integration at any time from your NotarySites.co account settings. You may also revoke access directly from your Google Account Permissions or Microsoft Account App Permissions page. Upon revocation, we will cease accessing your data from these services and delete stored access tokens within 24 hours.
Google API Services Compliance
NotarySites.co's use and transfer to any other app of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. For full details on how we handle Google data, please see our Privacy Policy.
Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Platform will be uninterrupted, secure, or error-free. We are not responsible for any errors or omissions in content, or for any loss or damage resulting from use of the Platform.
The Platform does not provide legal advice. You are responsible for ensuring your use of the Platform complies with all applicable notary laws and regulations in your jurisdiction.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOTARYSITES.CO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE PLATFORM.
OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
Indemnification
You agree to indemnify, defend, and hold harmless NotarySites.co and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any law or third-party rights
- Your Content or your notarization activities
Termination
We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. You may terminate your account at any time through your account settings.
Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.
Dispute Resolution
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
Arbitration
Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Miami, Florida.
Class Action Waiver
You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action.
Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes via email or through the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.
General Provisions
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and NotarySites.co regarding the Platform.
Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
Waiver: Our failure to enforce any provision of these Terms does not waive our right to enforce it later.
Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights at any time.
